En cumplimiento de la Ley 34/2002, de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI), se informa de que el software TradeKopier y el sitio web tradekopier.com pertenecen a:
3.1. Al descargar, instalar, activar o utilizar el Software aceptas por completo estos Términos, la Declaración de Riesgo y la Política de Privacidad publicadas en tradekopier.com. Si no estás de acuerdo, no descargues ni utilices el Software.
3.2. El Titular puede pedirte que aceptes expresamente estos Términos (por ejemplo, marcando una casilla) al descargar o activar el Software. En ese caso guardará constancia de tu aceptación, de la versión que aceptaste y de la fecha.
3.3. Declaras que eres mayor de 18 años y que tienes capacidad legal para contratar. Si utilizas el Software en nombre de una empresa, declaras que puedes obligarla, y la empresa quedará vinculada por estos Términos.
4.1. TradeKopier es solo una herramienta de software. Según la configuración que tú defines, intenta copiar en tus Cuentas Esclavas las órdenes que colocas en tu Cuenta Maestra. Además, ofrece Funciones de Riesgo y Contenido Informativo como ayuda.
4.2. TradeKopier no es un bróker, ni una empresa de servicios de inversión, ni un asesor financiero, ni un gestor de carteras, ni un proveedor de señales. El Titular:
4.3. El Software no decide qué, cuándo ni cuánto operar. Solo actúa según las órdenes que tú colocas y la configuración que tú estableces. Cada decisión de trading, y cada orden que resulte de ella en cualquiera de tus cuentas, es de tu exclusiva responsabilidad.
4.4. Nada de lo que aparece en el Software, en la web, en redes sociales, en el soporte o en cualquier comunicación del Titular es asesoramiento financiero, legal, fiscal o de inversión.
5.1. TradeKopier es un producto independiente desarrollado por el Titular. NinjaTrader® es una marca de NinjaTrader, LLC. Que TradeKopier aparezca en el NinjaTrader Ecosystem o en cualquier otro directorio no significa que NinjaTrader, LLC ni ninguna de sus sociedades vinculadas lo respalden, aprueben, certifiquen, recomienden o garanticen. Esto incluye a NinjaTrader Brokerage, NinjaTrader Clearing LLC y Tradovate.
5.2. El Titular no tiene ninguna relación con NinjaTrader Brokerage ni actúa en su nombre. NinjaTrader, LLC no es parte de estos Términos, no da soporte sobre TradeKopier y no asume ninguna responsabilidad frente al Usuario en relación con el Software.
5.3. Cualquier incidencia, consulta o reclamación sobre TradeKopier debe dirigirse exclusivamente al Titular, en los términos y con los límites previstos en estos Términos.
5.4. Los nombres, logotipos y marcas de brókeres, empresas de fondeo, plataformas y otros terceros que aparecen en la web o en el Software pertenecen a sus titulares. Solo se usan para indicar compatibilidad o para describir ofertas de terceros, y su mención no implica afiliación, patrocinio ni respaldo.
6.1. Siempre que cumplas estos Términos, el Titular te concede una licencia para instalar y utilizar el Software en tu propio trading. La licencia es personal y limitada, no exclusiva, intransferible y revocable, y no puedes sublicenciarla.
6.2. La licencia está vinculada a tu email y puede vincularse también a un equipo concreto. Para usarla hace falta conexión a internet, porque la licencia se valida periódicamente. Si el servicio de validación no está disponible por cualquier motivo, el Software puede no arrancar o dejar de funcionar, y el Titular no será responsable de ello.
6.3. Licencia gratuita. Hoy el Software se ofrece sin coste. El Titular puede en cualquier momento modificar, limitar o retirar la licencia gratuita, o introducir planes de pago, y lo avisará con antelación razonable cuando sea posible. Retirar o modificar la licencia gratuita no da derecho a ninguna indemnización.
6.4. Planes de pago. Si en el futuro hay planes de pago, se regirán además por las condiciones concretas que se muestren antes de la compra (precio, duración, renovación, cancelación y reembolsos). Si eres Consumidor y el contenido digital se te entrega de inmediato, se te pedirá que consientas expresamente que empiece la entrega y que reconozcas que por eso pierdes el derecho de desistimiento, en los términos de la normativa de consumo.
6.5. Está prohibido:
Reconoces que estas obligaciones son esenciales para usar el Software con seguridad, y que, si no las cumples, eres tú quien causa los daños que se produzcan.
7.1. Configuración. Solo tú eres responsable de configurar y revisar:
Antes de operar en real debes comprobar que el resultado es el que quieres.
7.2. Prueba previa en simulación. Debes probar el Software en cuentas de simulación antes de usarlo con cuentas reales o de fondeo. Tienes que repetir la prueba después de cada actualización del Software o de la Plataforma y después de cada cambio importante en la configuración.
7.3. Supervisión constante. Mientras el Software esté activo debes vigilar en tiempo real la Cuenta Maestra y todas las Cuentas Esclavas, y comprobar que cada orden y cada posición se han copiado bien. No dejes el Software funcionando sin supervisión.
7.4. Obligación de intervenir. Si ves cualquier anomalía, debes detener la réplica de inmediato y gestionar tus posiciones a mano. Por ejemplo:
7.5. Controles de riesgo propios. Debes mantener en todo momento tus propios controles de riesgo, independientes del Software. En particular, órdenes de stop colocadas en tu bróker y los límites de pérdida que ofrezca tu bróker o tu empresa de fondeo. Las Funciones de Riesgo de TradeKopier son una ayuda complementaria y nunca sustituyen a esos controles.
7.6. Entorno técnico. Eres responsable de:
7.7. Normas de brókeres y empresas de fondeo. Solo tú eres responsable de conocer y cumplir las normas de cada bróker y empresa de fondeo con los que operes. Entre otras, las que se refieren a:
Algunas empresas de fondeo limitan o prohíben usar copiadores, o copiar operaciones entre cuentas de distintos titulares. Antes de usar el Software debes confirmar con cada una que lo que vas a hacer está permitido.
7.8. Legalidad. Debes asegurarte de que el trading y el uso del Software son legales en tu país de residencia.
7.9. Registros. Debes guardar tus propios registros de operaciones. Los datos del diario de trading del Software son solo informativos y pueden estar incompletos o ser inexactos.
8.1. Solo puedes conectar al Software cuentas de las que seas titular o que estés legalmente autorizado a operar.
8.2. Está prohibido usar el Software para operar o copiar operaciones en cuentas de otras personas (por ejemplo, de clientes, familiares, amigos o suscriptores) sin las autorizaciones y licencias que exija la ley, porque esa actividad puede ser un servicio de inversión regulado.
8.3. Si, a pesar de lo anterior, usas el Software en cuentas de otras personas, lo haces bajo tu exclusiva responsabilidad. El Titular no asume ninguna obligación ni responsabilidad frente a ellas.
Se te ha informado, entiendes y aceptas expresamente que, aunque uses el Software correctamente y el Titular se esfuerce razonablemente, pueden ocurrir, entre otras, las siguientes situaciones:
Utilizas el Software bajo tu propio riesgo.
10.1. El Contenido Informativo es solo informativo. Puede tener errores o estar desactualizado, y no es una recomendación de inversión. No debes basar tus decisiones de trading en él.
10.2. Las tarjetas de resultados y las estadísticas que generas con el Software se basan en tus datos, y el Titular no las verifica. Si las compartes en público, solo tú respondes de que sean exactas y de no usarlas para hacer afirmaciones de rentabilidad engañosas.
10.3. Algunos enlaces, códigos de descuento u ofertas de terceros que aparecen en el Software o en la web pueden ser enlaces de afiliado, por los que el Titular puede recibir una compensación. Esto incluye los enlaces para descargar la Plataforma. Incluirlos no es una recomendación. Los productos y servicios de terceros se rigen por sus propias condiciones, y el Titular no responde de ellos, de su disponibilidad ni de los cambios en sus ofertas.
11.1. El soporte se ofrece por email y a través del chat de la web, en la medida en que sea razonablemente posible. No hay compromiso de disponibilidad ni de tiempos de respuesta, salvo que se acuerde expresamente y por escrito.
11.2. El chat de la web puede estar atendido por un asistente automático basado en inteligencia artificial. Sus respuestas se generan de forma automática y pueden tener errores. No son asesoramiento profesional ni suponen ningún compromiso del Titular. Para temas importantes, escribe por email.
12.1. EN LA MÁXIMA MEDIDA QUE PERMITA LA LEY APLICABLE, EL SOFTWARE Y TODOS LOS SERVICIOS ASOCIADOS SE OFRECEN "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN NINGÚN TIPO DE GARANTÍA, EXPRESA O IMPLÍCITA. ESTO INCLUYE LAS GARANTÍAS DE IDONEIDAD PARA UN FIN CONCRETO, COMERCIABILIDAD, EXACTITUD, AUSENCIA DE ERRORES, FUNCIONAMIENTO ININTERRUMPIDO, COMPATIBILIDAD CON FUTURAS VERSIONES DE LA PLATAFORMA Y NO INFRACCIÓN DE DERECHOS DE TERCEROS.
12.2. El Titular no garantiza que el Software copie todas las órdenes, ni que lo haga en un tiempo concreto, ni que las Funciones de Riesgo actúen en todos los casos. Tampoco garantiza que usar el Software genere beneficios o evite pérdidas.
12.3. Salvo en lo que la normativa de consumo imponga de forma obligatoria, ninguna información publicitaria, comercial o de soporte supone una garantía distinta de las que recogen estos Términos.
12.4. Si eres Consumidor, esta sección no limita los derechos irrenunciables que te reconoce la normativa de consumo, incluidos los relativos a la conformidad de los contenidos digitales.
13.1. EN LA MÁXIMA MEDIDA QUE PERMITA LA LEY APLICABLE, EL TITULAR NO RESPONDE DE:
13.2. Límite de importe. En la máxima medida que permita la ley aplicable, la responsabilidad total del Titular frente a ti, sumando todas las causas relacionadas con el Software o con estos Términos, no superará la mayor de estas dos cantidades:
13.3. Responsabilidades que no se limitan. Nada de lo previsto en estos Términos excluye ni limita la responsabilidad del Titular por dolo o culpa grave, por daños a la vida o a la integridad física de las personas, ni ninguna otra responsabilidad que la ley aplicable no permita excluir o limitar. En esos casos, la responsabilidad solo se limitará hasta donde la ley lo permita.
13.4. Estas limitaciones se aplican sea cual sea el fundamento de la reclamación (contractual, extracontractual o cualquier otro), aunque se hubiera advertido al Titular de que esos daños podían producirse. Son una condición esencial de cómo se ofrece el Software, en particular de que se ofrezca gratis.
13.5. Aviso de incidencias. Debes comunicar cualquier incidencia por escrito a soporte@tradekopier.com lo antes posible desde que la detectes. Incluye la información que tengas (fecha, cuentas afectadas y registros) para que se pueda analizar y limitar sus efectos. Si no eres Consumidor, tienes un plazo de un (1) año desde el hecho que causó el daño para presentar cualquier reclamación.
14.1. En la medida que permita la ley aplicable, te comprometes a defender al Titular (y, en su caso, a la sociedad que le suceda), a dejarle libre de toda responsabilidad y a compensarle por cualquier reclamación, daño, sanción, coste o gasto, incluidos los honorarios razonables de abogados y procuradores, que se deriven de:
14.2. Si eres Consumidor, esta obligación solo se aplica cuando el daño se deba a tu incumplimiento o a una actuación tuya dolosa o negligente.
15.1. El Titular puede actualizar, modificar, suspender o retirar en cualquier momento el Software, o cualquiera de sus funciones, total o parcialmente. Intentará avisar con antelación razonable de los cambios importantes.
15.2. El Titular no garantiza que el Software sea compatible con futuras versiones de la Plataforma ni que siga disponible, y no será responsable si deja de ofrecerlo. Las versiones antiguas pueden dejar de funcionar o de tener soporte.
15.3. Las funciones marcadas como "beta", "nuevo" o experimentales pueden ser especialmente inestables.
16.1. El Titular puede suspender o revocar tu licencia, sin que tengas derecho a indemnización:
16.2. Puedes dejar de usar el Software y desinstalarlo cuando quieras.
16.3. Cuando la licencia termine, debes desinstalar el Software. Las secciones 5, 6.5, 8.3, 9, 10, 12, 13, 14, 17, 22 y 23 siguen en vigor después de que la licencia termine.
17.1. El Software, su código, su diseño, su documentación, la marca TradeKopier y el resto de sus elementos son propiedad del Titular o de quienes le han dado licencia. Estos Términos no te dan ningún derecho sobre ellos más allá de la licencia de la sección 6.
17.2. Si nos envías sugerencias o comentarios, podemos usarlos libremente, sin obligación de compensarte.
El tratamiento de tus datos personales se rige por la Política de Privacidad publicada en tradekopier.com. En ella se explica, entre otras cosas:
El Titular no será responsable de incumplimientos ni retrasos debidos a causas que estén fuera de su control razonable. Por ejemplo:
20.1. No puedes ceder ni traspasar estos Términos ni tu licencia sin el consentimiento previo y por escrito del Titular.
20.2. El Titular puede ceder su posición en estos Términos, incluidas las licencias ya concedidas, a una sociedad que controle o a quien le suceda como titular del Software. Te lo comunicará por email o en la web.
21.1. El Titular puede modificar estos Términos. La versión vigente se publicará en tradekopier.com con su fecha de actualización. Los cambios importantes se avisarán por email o dentro del Software con antelación razonable.
21.2. Si no aceptas la nueva versión, debes dejar de usar el Software. Si sigues usándolo después de que entre en vigor, o si la aceptas expresamente cuando se te pida, aceptas los nuevos Términos.
22.1. Estos Términos se rigen por la legislación española.
22.2. Antes de acudir a los tribunales, las partes intentarán resolver el conflicto de forma amistosa durante treinta (30) días, contados desde que se comunique por escrito a soporte@tradekopier.com.
22.3. Si no eres Consumidor, las partes se someten en exclusiva a los juzgados y tribunales del domicilio del Titular y renuncian a cualquier otro fuero.
22.4. Si eres Consumidor, serán competentes los juzgados y tribunales que correspondan según la normativa aplicable. Nada de lo previsto aquí te privará de la protección que te den las normas obligatorias de tu país de residencia.
23.1. Si una cláusula se declara nula o inaplicable, esto solo afecta a esa cláusula o a la parte de ella que sea nula. El resto de los Términos sigue siendo válido.
23.2. Estos Términos, junto con la Declaración de Riesgo y la Política de Privacidad, son el acuerdo completo entre las partes sobre el Software.
23.3. Que el Titular no ejerza un derecho no significa que renuncie a él.
23.4. Estos Términos están redactados en español. Si hay diferencias entre esta versión y una traducción, prevalece la versión española, salvo que la ley disponga otra cosa.
23.5. Las comunicaciones se harán por email: a ti, en la dirección asociada a tu licencia; al Titular, en soporte@tradekopier.com.

3.2. The Owner may ask you to expressly accept these Terms (for example, by ticking a box) when you download or activate the Software. In that case, the Owner will keep a record of your acceptance, the version you accepted and the date.
3.3. You declare that you are over 18 and have the legal capacity to enter into contracts. If you use the Software on behalf of a company, you declare that you are authorized to bind it, and the company will be bound by these Terms.
4.1. TradeKopier is only a software tool. According to the configuration you define, it attempts to copy the orders you place in your Master Account to your Slave Accounts. It also offers Risk Features and Informational Content as aids.
4.2. TradeKopier is not a broker, an investment firm, a financial advisor, a portfolio manager or a signal provider. The Owner:
4.3. The Software does not decide what, when or how much to trade. It only acts on the orders you place and the configuration you set. Every trading decision, and every resulting order in any of your accounts, is your sole responsibility.
4.4. Nothing in the Software, on the website, on social media, in support or in any communication from the Owner constitutes financial, legal, tax or investment advice.
5.1. TradeKopier is an independent product developed by the Owner. NinjaTrader® is a trademark of NinjaTrader, LLC. The listing of TradeKopier on the NinjaTrader Ecosystem or any other directory does not mean that NinjaTrader, LLC or any of its affiliates endorse, approve, certify, recommend or guarantee it. This includes NinjaTrader Brokerage, NinjaTrader Clearing LLC and Tradovate.
5.2. The Owner has no relationship with NinjaTrader Brokerage and does not act on its behalf. NinjaTrader, LLC is not a party to these Terms, does not provide support for TradeKopier and assumes no liability to the User in connection with the Software.
5.3. Any issue, question or claim relating to TradeKopier must be addressed exclusively to the Owner, on the terms and within the limits set out in these Terms.
5.4. The names, logos and trademarks of brokers, prop firms, platforms and other third parties shown on the website or in the Software belong to their owners. They are used only to indicate compatibility or to describe third-party offers, and their mention does not imply affiliation, sponsorship or endorsement.
6.1. As long as you comply with these Terms, the Owner grants you a license to install and use the Software for your own trading. The license is personal and limited, non-exclusive, non-transferable and revocable, and you may not sublicense it.
6.2. The license is linked to your email and may also be linked to a specific computer. An internet connection is required because the license is validated periodically. If the validation service is unavailable for any reason, the Software may not start or may stop working, and the Owner will not be liable for this.
6.3. Free license. The Software is currently offered free of charge. The Owner may at any time modify, limit or withdraw the free license, or introduce paid plans, and will give reasonable advance notice where possible. Withdrawing or modifying the free license does not give rise to any compensation.
6.4. Paid plans. If paid plans are offered in the future, they will also be governed by the specific conditions shown before purchase (price, duration, renewal, cancellation and refunds). If you are a Consumer and the digital content is supplied immediately, you will be asked to expressly consent to the start of supply and to acknowledge that you therefore lose your right of withdrawal, as provided by consumer law.
6.5. You may not:
You acknowledge that these obligations are essential for using the Software safely and that, if you fail to comply with them, you are the one causing any resulting damage.
7.1. Configuration. You alone are responsible for configuring and reviewing:
Before trading live, you must check that the result is what you intend.
7.2. Prior testing in simulation. You must test the Software on simulation accounts before using it with live or funded accounts. You must repeat this test after every update of the Software or the Platform and after every significant configuration change.
7.3. Constant monitoring. While the Software is active, you must monitor the Master Account and all Slave Accounts in real time and check that every order and position has been copied correctly. Do not leave the Software running unattended.
7.4. Duty to intervene. If you notice any anomaly, you must stop replication immediately and manage your positions manually. For example:
7.5. Your own risk controls. You must maintain at all times your own risk controls, independent of the Software. In particular, stop orders placed with your broker and the loss limits offered by your broker or prop firm. TradeKopier's Risk Features are a complementary aid and never replace those controls.
7.6. Technical environment. You are responsible for:
7.7. Broker and prop firm rules. You alone are responsible for knowing and complying with the rules of every broker and prop firm you trade with, including those concerning:
Some prop firms restrict or prohibit trade copiers, or copying trades between accounts of different holders. Before using the Software, you must confirm with each of them that what you intend to do is allowed.
7.8. Legality. You must make sure that trading and using the Software are legal in your country of residence.
7.9. Records. You must keep your own trading records. The Software's trading journal data is for information only and may be incomplete or inaccurate.
8.1. You may only connect to the Software accounts that you own or are legally authorized to operate.
8.2. You may not use the Software to trade or copy trades in other people's accounts (for example, clients, relatives, friends or subscribers) without the authorizations and licenses required by law, because that activity may be a regulated investment service.
8.3. If, despite the above, you use the Software on other people's accounts, you do so at your sole responsibility. The Owner assumes no obligation or liability towards them.
You have been informed, understand and expressly accept that, even if you use the Software correctly and the Owner makes reasonable efforts, the following situations, among others, may occur:
You use the Software at your own risk.
10.1. Informational Content is for information only. It may contain errors or be out of date, and it is not an investment recommendation. You must not base your trading decisions on it.
10.2. The results cards and statistics you generate with the Software are based on your data, and the Owner does not verify them. If you share them publicly, you alone are responsible for their accuracy and for not using them to make misleading performance claims.
10.3. Some links, discount codes or third-party offers shown in the Software or on the website may be affiliate links, for which the Owner may receive compensation. This includes links to download the Platform. Their inclusion is not a recommendation. Third-party products and services are governed by their own terms, and the Owner is not responsible for them, for their availability or for changes to their offers.
11.1. Support is provided by email and through the website chat, to the extent reasonably possible. There is no commitment to availability or response times, unless expressly agreed in writing.
11.2. The website chat may be handled by an automated assistant based on artificial intelligence. Its answers are generated automatically and may contain errors. They are not professional advice and do not bind the Owner. For important matters, write by email.
12.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND ALL ASSOCIATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, ACCURACY, ABSENCE OF ERRORS, UNINTERRUPTED OPERATION, COMPATIBILITY WITH FUTURE VERSIONS OF THE PLATFORM AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
12.2. The Owner does not guarantee that the Software will copy every order, that it will do so within a specific time, or that the Risk Features will act in every case. Nor does the Owner guarantee that using the Software will generate profits or prevent losses.
12.3. Except where consumer law mandatorily provides otherwise, no advertising, commercial or support information constitutes a warranty other than those set out in these Terms.
12.4. If you are a Consumer, this section does not limit the non-waivable rights granted to you by consumer law, including those relating to the conformity of digital content.
13.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OWNER IS NOT LIABLE FOR:
13.2. Cap on liability. To the maximum extent permitted by applicable law, the Owner's total liability to you, for all causes related to the Software or these Terms combined, will not exceed the greater of:
13.3. Liability that is not limited. Nothing in these Terms excludes or limits the Owner's liability for fraud or wilful misconduct, gross negligence, death or personal injury, or any other liability that cannot be excluded or limited under applicable law. In those cases, liability will only be limited to the extent permitted by law.
13.4. These limitations apply whatever the basis of the claim (contract, tort or any other), even if the Owner was advised that such damage might occur. They are an essential condition of how the Software is offered, in particular of its being offered free of charge.
13.5. Reporting incidents. You must report any incident in writing to soporte@tradekopier.com as soon as possible after you detect it. Include the information you have (date, affected accounts and logs) so it can be analyzed and its effects limited. If you are not a Consumer, you have one (1) year from the event that caused the damage to bring any claim.
14.1. To the extent permitted by applicable law, you agree to defend the Owner (and, where applicable, any company succeeding the Owner), to hold the Owner harmless and to compensate the Owner for any claim, damage, penalty, cost or expense, including reasonable legal fees, arising from:
14.2. If you are a Consumer, this obligation only applies when the damage is due to your breach or to wilful or negligent conduct on your part.
15.1. The Owner may update, modify, suspend or discontinue the Software, or any of its features, in whole or in part, at any time. The Owner will try to give reasonable advance notice of significant changes.
15.2. The Owner does not guarantee that the Software will be compatible with future versions of the Platform or that it will remain available, and will not be liable if it stops offering it. Older versions may stop working or stop being supported.
15.3. Features marked as "beta", "new" or experimental may be particularly unstable.
16.1. The Owner may suspend or revoke your license, without you being entitled to compensation:
16.2. You may stop using the Software and uninstall it whenever you want.
16.3. When the license ends, you must uninstall the Software. Sections 5, 6.5, 8.3, 9, 10, 12, 13, 14, 17, 22 and 23 remain in force after the license ends.
17.1. The Software, its code, design, documentation, the TradeKopier brand and all its other elements belong to the Owner or to the Owner's licensors. These Terms give you no rights over them beyond the license in section 6.
17.2. If you send us suggestions or feedback, we may use them freely, without any obligation to compensate you.

The Owner will not be liable for failures or delays due to causes beyond its reasonable control. For example:
20.1. You may not assign or transfer these Terms or your license without the Owner's prior written consent.
20.2. The Owner may assign its position under these Terms, including licenses already granted, to a company it controls or to a successor as owner of the Software. The Owner will notify you by email or on the website.
21.1. The Owner may modify these Terms. The current version will be published on tradekopier.com with its update date. Significant changes will be notified by email or within the Software with reasonable advance notice.
21.2. If you do not accept the new version, you must stop using the Software. If you continue to use it after it takes effect, or if you expressly accept it when asked, you accept the new Terms.
22.1. These Terms are governed by Spanish law.
22.2. Before going to court, the parties will try to resolve the dispute amicably for thirty (30) days from written notice to soporte@tradekopier.com.
22.3. If you are not a Consumer, the parties submit exclusively to the courts of the Owner's domicile and waive any other jurisdiction.
22.4. If you are a Consumer, the competent courts will be those determined by applicable law. Nothing here will deprive you of the protection granted by the mandatory rules of your country of residence.
23.1. If a clause is declared void or unenforceable, this only affects that clause or the part of it that is void. The rest of the Terms remains valid.
23.2. These Terms, together with the Risk Disclosure and the Privacy Policy, are the entire agreement between the parties regarding the Software.
23.3. The Owner's failure to exercise a right does not mean that the Owner waives it.
23.4. These Terms are drafted in Spanish. If there are differences between the Spanish version and a translation, the Spanish version prevails, unless the law provides otherwise.
